inheritance cycle of violence

الجمعة, مايو 27, 2011 هداية صالح 0

The Eighth of March & Women Unified by Suffering: Inheritance, the Most Severe Cycle of Violence By: Hedaya Shamun * Persons responsible for causing women’s denial of inheritance were their brothers, who are either a Legal Counsel, Imam of a mosque, Director of a civil institution, PhD degree holder, etc… The most perpetrators of depriving women of their inheritance are brothers followed by parents. The denial of women's inheritance is not related to the social, educational, or cultural levels, or even to the degree of religiosity. Rather, it is related to wealth that must be owned by the powerful and deprived of the powerless. The cultural and social heritage is controlled by men as a force on the riches of their families; those men do not accept sharing the riches with women, especially the married. This becomes more difficult when the inheritance is land and property in kind. Many stories told by women deprived of their inheritance are capable of beating the bell of violence of women. The social acceptance of women’s denial of inheritance contributes mainly in the consecration and reproducing the deliberate culture of violence against women, and it intentionally overlooks their humanitarian and legitimate rights in the legacy of their families. The control and desire to possess the wealth of the family has become a male tradition; few men accept to give women their legitimate shares of inheritance. It is found that trying to maintain wealth may push up the cycle of violence to the highest level, including murder. Some women were killed in attempt to access to inheritance, and others’ reputations were distorted due to false accusations that are not unfounded In addition, trying to maintain wealth may lead to other levels of physical violence, and more painfully psychological violence. Women may also be abandoned by family; this makes them feel oppressed, and as a result they feel forced to return to the shadow of men, who are considered a source of protection even though they are the perpetrators of such violence against women. It seems that males understand well the nature of society and power relations and realize that women are the weakest link in society. They are aware of that leaving women unprotected is unbearable to them. In fact, it was found in a research study on the denial of women's inheritance that the main reason for women not demanding their inheritance was the fear of causing problems and family disintegration that they do not desire to happen. "Buthaina" was forced by her brother, who is a medical doctor, to sign a concession paper, disclaiming her right to the inheritance of her father; this was to allow her to marry. When she refused to sign, her brother deprived her of marriage and practiced pressure to force her to disclaim her inheritance. After eight years following the death of her father, Buthaina is still unmarried and deprived of her right to inheritance. "Nahla" is a married woman whose economic status is extremely bad. Her brothers forced her to sign a concession paper, waiving her inheritance right of her father’s land and property to them. At the same time, her husband exercised violence against her, burning her clothes and forcing her to leave the house. This was an attempt of forcing her to claim her right. She found herself the victim of two greedy parties. She could not claim her right because the brothers threatened to break up familial relationship. And she could not live with her husband, who still covets her inheritance right. For Um Mohammed (the mother of Mohammed), her story of suffering continues to speak about the injustice of her paternal uncle and his sons. Instead of being supportive in the absence of her late father, who left her and her other 5 sisters a land and house gotten by their father’s hard working in addition to their efforts since they left school to help him then, her uncle and his sons were the cause of her and sisters’ sufferings. The greedy uncle and his sons beat and attacked them with knives, trying to prevent them from reporting a complaint to the police. Finally, they could get to the police and report the attack. However, the sisters’ suffering continues under the intransigence of their uncle and his sons, who occasionally try to force them to relinquish their rights. What injustice that speaks on behalf of its perpetrators! The eldest daughter, Um Ahmed, had been claiming her right and the right of her mother (the heirs of the family) of more than 100 donums from her maternal uncles for 45 years; the mother of Um Ahmed did not receive this right and passed away, feeling oppressed. Yet, Um Ahmed continues claiming her right and the right of her three sisters. But, her maternal uncles and their children broke up their familial relationship with her and her three sisters and denied their rights. Um Ahmed is still home praying for her children to get life sustenance, not forgiving the perpetrators of her denial of inheritance. Samira was denied her right of two and a half donums by her brother. She raised a complaint against her brothers after encountering certain difficulties, including her critical, financial situation, the martyrdom of one of her sons during the latest Israeli assault on the Gaza Strip, and the injury of another son who is in need of surgery. Although she did not stop attempts to reconciliation and peace through tribal chiefs, police, and lawyers, the brothers did not bat an eyelid and stayed away from her, and she was not given her right. She is torn by the tyranny of her brother, weakness of the relatives, silence of community, and law procedures that take forever to take her right and live an auspicious day. There are many stories of women that are painful to death. The most heinous story was Heba’s, who was kidnapped by her paternal half brothers. She was also assaulted by one of her brothers, who hit her head with a machete in her mother's house. This brother justified his attack by saying it was an issue of honor the issue, and he washed the shame. Fortunately, it was her destiny to live, and she was supported by the good people. She is still alive to bear witness to injustice and cruelty of greedy relatives that deprive women of their rights to inheritance and of their dignity regardless to community ties, as if women are the only ones who claim to maintain these ties while they are impeccable. The Women’s Affairs Center (WAC) has observed 100 cases of women deprived of their inheritance in the governorates of the Gaza Strip, and whose sufferings continue. March goes and comes, another goes and comes, and masculine culture and the distinction between male and female reproduces itself. And women are still subjected to many forms of violence and persecution. It has been shown by a recent study of the Information & Research Program of the WAC-Gaza that 23.8% of the total female respondents asserted denial of inheritance, while 76.2% indicated that they were not deprived of inheritance. In the same study, a representative sample of 370 women; (42%) of the representative sample of 370 women stressed that the fear of losing relationship with family was the main reason that prevent them from seeking any support to get their right to inheritance. And 26% of them considered claiming inheritance is a disgrace; some women would literally say about a woman who claims inheritance "She went to raise an issue against her family in courts," which simply indicates a disgrace. The study sample stressed on the effects of deprivation of inheritance; the results of the study showed that that feeling of oppression, injustice, and persecution weighted by (62.2%), enmity and hatred between siblings and family weighted by (49.5%), destabilization and disintegration of family relations weighted by (44.3%), and psychological and physical impact on women weighted by (31.6%). The results also showed the women’s fear levels when claiming their rights; high (44%) of the study sample showed “high” level of fear, while (14.3%) of the study sample showed “medium” level of fear. Revealing the untold story is a pressing issue for all supporters of women's concerns. Perhaps the upcoming March, women will have been given some of their rights. Although the picture is bleak, hard working and real networking between women's and human rights organizations are able to create a state of social movement. Thus, silence of community must not be accepted by us, we women, whether we were harmed and deprived, or we were leaders and activists. What is lost right behind demands! Study Abstract "The Reality of Women in Al-Mawasi Neighborhood in Rafah" Women's Affairs Center - Research Program Researcher: Hedaya Shamun Introduction: Women are in a closed circle as they are simple and rural. Some are educated, but the largest proportion of them is illiterate. They have a thousand apprehensions about the caskets of life: poverty and unemployment. Their lives revolve in the orbit of constant fear of how to manage everyday life. Their deep concern is always over the future of their children whose childhood was robbed by the brutality of the Israeli occupation. Accordingly, this study idea depends upon identifying the needs and concerns of women in Al-Mawasi neighborhood. Objectives of the Study: The main objectives of this particular study include: 1 - Identifying the social, economic, and health situation of women in Al-Mawasi. 2 - Identifying the effects of the Israeli occupation on women in Al-Mawasi. 3 - Providing an updated database on women in Al-Mawasi to women's and civil society institutions. This is to identify the needs and demands of all women in the target area, in order to be covered by and included in the plans of the concerned institutions. Importance of the Study: The Israeli blockade, since the beginning of Al Aqsa Intifada and until the withdrawal of the Israeli occupation from Al-Mawasi, has been an additional burden on women's lives. The importance of this study comes as a result of the lack of a database of women and the lack of adequate information of their needs in Al-Mawasi neighborhood. This makes the capacity of NGOs to define these needs limited since these needs are individually and randomly identified. The study will be an essential reference for any special studies on the neighborhood. This study also sheds light on the marginalized areas in the Gaza Strip as well as the compounded suffering of the rural women. Methodology of the Study: In order to realize the objectives of the study, the researcher used the analytical descriptive method, which fulfills the purposes of this study. There was a try to approach the feminist research methodology. The study used the following tools: 1- Literature Review: It was used due to the lack of studies on Al-Mawasi neighborhood. 2- Focus Groups: Two focus groups were held in Al-Mawasi, in order to listen to the concerns of women and to give the opportunity for women to freely participate and share their views. 3- Interviews: Two interviews were conducted. One was with one of the women leaders in Al-Mawasi. And the second was with a director of civil society institutions serving the people of Al-Mawasi. 4- َQuestionnaire: Data were collected through questionnaires. The data entry, transcription, and analysis were done using the statistical program, SPSS. Study Sample: There was a random sample of (102) women, aged between (18-45), selected from the study population. And all questionnaires were retrieved. Situation of Women during the Israeli occupation: A very difficult period: (93.1%) of women in Al-Mawasi confirmed and described the period of occupation as "Very Difficult." And (5.9%) of them confirmed it was "Difficult." This is to say that almost all women agreed that they and their families faced difficulties during the Israeli occupation. Also, (65.7%) of women was personally affected by the Israeli occupation practices, while (34.3%) of them was not. Deterioration of Psychological Situation of Women: The majority of women confirmed the damage inflicted upon them as a result of the practices of the Israeli occupation. The deterioration of psychological situation came in the first place with almost (70%). This means that most families were harmed by the Israeli occupation, which still has negative effects on women despite the Israeli withdrawal from their neighborhoods. Also, the five-year blockade has worsened their life. The dispersion and forced migration of family members came second with (13.7%). Needs of Women from Institutions: There is exactly an unclear relationship between the women in Al- Mawasi and institutions actively working in the same neighborhood. Women do not have confidence in all institutions; they feel these institutions did not offer them a lot. (25.5%) of women are dissatisfied with the role of institutions. (6.9%) of them are totally dissatisfied with the role of institutions. They stressed that no one supported them. While (11.85) of women are strongly satisfied with the role of institutions, (22.5%) are satisfied. Main Results of the study: 1 – Women in Al-Mawasi live in extreme poverty, which has the greatest impact on community concerns that are considered accessories by women. It has also been a major cause of decline in women's social role. 2 - Women look for a source of security and protection for their families and the basic needs to cover essential living costs. 3 - Women believe in the importance and necessity of education of both girls and boys. Yet, marriage is still more important than education. They have full conviction that marriage offers protection. 4 - Contrary to all expectation, women's situation got worsened after the Israeli withdrawal. They still feel that they are socially isolated from the rest of Rafah neighborhoods. Such areas have not been considered for improvements for years. 5 - Women in Al-Mawasi lived a very difficult life during the Israeli occupation. They still suffer from serious psychological effects, which need intervention from the institutions concerned about women and children. 6 - Women have suffered from many difficulties during the Israeli siege, where the deterioration of the psychological situation came in the first place. Other difficulties include family dispersion, displacement of homes, and drop out of education. 7 - Women stressed that the most difficult situation that affected them and is still engraved in the memories is the Israeli checkpoints. Each woman and child has experienced the scourge of these checkpoints. 8 - Women recognize the important role of civil and women's institutions working in their neighborhood. However, the current institutions are not meeting the real needs and ambitions of them. Therefore, women are demanding more projects to develop their potential due to the lack of the minimum services in the neighborhood. 9 - Courses of awareness and education are no of greatest interest to women. On the contrary, women demand income-generating projects that help me meet the basic needs of their families. They also demand intensive, professional awareness courses that help them provide the basic needs in the future. Main Recommendations of the Study: 1 - Need to work on the psychological aspect of women in Al-Mawasi, taking into account their difficult living circumstances during the Israel occupation period. They stressed they have not overcome this difficult period yet; they need moral and psychological support. Therefore, it is better for institutions concerned to create orientation programs of long-term and intensive treatment to support women in Al- Mawasi. 2 - Need to raise women's knowledge of the importance of education and awareness, either through workshops, lectures or seminars at no cost. This needs to intensify efforts and work in cooperation with women, residents and institutions. 3 - Need to recognize and award women in Al-Mawasi for their persistence during the consecutive five years of blockade, facing Israeli occupation and militarization of the settlers. Women should be dealt as a group that has been suffering. They should not be viewed as inferior, and they should not be helped only by the distribution of coupons that are later exchanged for food items. In contrast, they should be dealt with as freedom fighters. 4 - Need to work to improve the income of households in Al- Mawasi through projects offered to this neighborhood. Since the basic needs are not available to them, they are not expected to interact and benefit by any means. 5 - Women in Al- Mawasi have real potential. Accordingly, women's institutions should support and provide them with moral services. These institutions are the link that women should take advantage of. 6 - Need to pay attention to the young generation of women who aspire for education. They should be supported to enable them support their neighborhood in the future. 7 - Need to document the stories and experiences of women in Al-Mawasi during the five-year Israeli blockade. This is to be a witness to the occupation's violence against women and children in this neighborhood. 8 - Need to work to integrate women in Al-Mawasi into joint programs and activities with women of Rafah city. This is to reduce the sense of social isolation.

"Sedqi!! Sedqi died… Ahmed died… Mohamed died…" this is what little two-year Ne’ma keeps saying when hearing her brothers’ names. She calls her mother, too, who is receiving the medical treatment in the Egyptian hospital. "Mom died" she added. Despite being a baby, Ne’ma was not safe from the Israeli shelling. They shelled her house and her parents’ bedroom where she, her brothers, and parents used to hide together away from the Israeli bombs and explosions. She miraculously stayed alive. Having seen her front burnt and little body covered with blood, no one was able to believe that she was destined to live. Zeyad Mahmoud Yousuf Al Abssy is Ne’ma’s father. He resides in Yebna refugee camp in Rafa to the south of the Gaza strip. He remembered what happened saying "in the night of the 28th of Dec. 2008, I went back to home at 10:00 pm. I found my ten-member family prepared for having dinner and I shared them. We moved after to sleep all in the same room. It was midnight when we slept. Suddenly, feeling nothing, I opened my eyes to find myself flying towards the asbestos ceiling of my bedroom… My wife was enfolding our little daughter Ni’mah and suckling her… then, we all fall down and the ground was shaking beneath our feet…we heard nothing… losing our gravity, we felt as if something pushing us over the top. We were falling under the rubble, covered with blood. That scene, I will never forget". "I thought it is a dream, I saw the people pushed towards us… I was not really realizing things… people were all around, screaming and trying to help us out from under the rubble… then, I fainted. I woke up in the hospital; I had blood flow in my arms. I stayed in Al-Najar hospital… I asked about my sons, daughters, they told me that they are in the same hospital getting medical treatment. People visited us and they were crying; but I actually understood nothing. I did not realize what happened. I was hit in my head and got 10 stitches in my head, 7 in my back and my left arm was broken". He added. Go my dears, only God can give you back your rights "In the next day, my brother came to visit me. Nobody dared to tell me what has happened. Then, they told me they will bury my children bodies (Mohamed 12 years old, Sedqi 4 years old, and Ahmed 11 years old). I was able to do nothing but thank Allah-Praise to be God. I wanted to farewell them before being buried. They carried me on a wheelchair. When I saw them in the morgue, their innocent faces, I cried and told them before everybody "Dear sons, only God can give you back your rights from this inequitable tyrannous world. I am no longer able do anything for you". The bereaved father kept silent. His heart was tore up for the loss of his sons. And despite having wounds have not healed yet, he found himself searching for the rest of his family. He managed to leave the hospital in the third day so as to accept the condolences over his three martyr sons. His daughter Zakeia- 15-years old- got her arm broken. She said" I was sleeping, when suddenly I found myself inside the ambulance. I did not realize what happened. Medics were taking us to the hospital. My hands were opened and blood was flowed covering my clothes. I stayed there for 25 days." With a pale face, and dominant silence, Zakeia remembered her dead brothers saying" I knew nothing. I thought they were all injured, just like me, as my relatives told me. By chance, a doctor came to check out, and thinking I am sleeping, he said she is the girl who was survived while three of her brothers were martyred. I was shocked, I didn’t believe at first, then my aunt told me that they are birds in Paradise by now. That was what she said and I cried a lot. I can’t believe they died. I just keep remembering them with my brothers and cry a lot." Zakeia fell silent and her eyes were overflowed with tears, she added "I pray to God every moment to have my mother back, we need her so much, we are just children and we are no more able to endure this". About the wife situation, Abssi said" little Ne’ma was survived as her mother was holding her. When the missile exploded, the wall and ceilings were blown around us, and my wife seemed to embrace little Ni’ma as the medics said. They took them together to the ambulance after. When I visited her in Nasser Hospital in Khanyouniss, she was in critical situation but struggling for her life. I cried when I saw her. I did not know her. She was intubated and her body was swollen. She was in coma as she suffered fractures in her back and chest. She got 20 stitches in her head. When the medics brought her out the rubble they thought she was lifeless. Now she is in Egypt receiving the medical treatment for we can’t manage her wounds in Gaza." Looking at the sky, Al-Abssi prayed to god saying" Oh, my Lord, bring my wife back to me and my children. Bring her back to her Ne’ma. I won’t cross my arms. I will sue the killers. We are civilians we form no danger for anybody. We were safe in our house… why we would be targeted by the Israeli warplanes while sleeping in the night??" Zakeia said" all the family members got his share of injuries. My sister Nida’ -19 years old- was hit in the head. Feda’ as well was hit in the head. My father and mother were injured, too. Our house was totally demolished and we have nothing now. we live now at my Uncle’s house with my grandmother. We have no house now. We are no more a family. Until now, I went through two surgeries. They put platinum in my arm. I went through a skin transplantation as well. And will have a third surgery within a month". Concerning Ne’ma she was hit in the forefront, neck feet, and part of her tongue was cut. Little Ne’ma was hospitalized for a week. When her brothers went to see her, she was not able to know them. Whenever they mention the names of her martyred brother she replies" Died…Died!!" This baby was finally joined to her sister and brothers. They took care of her. They all wait for the return of their mother to support them in this plight. The father brought up the memories "after my departure from the hospital, my neighbors told me that they found my children’s’ bodies about 35 meters away from the house after the explosion". He added "I used to carry Sedqi on my shoulders while Ahmed and Mohamed used to walk beside me. I don’t know how to handle their absence. I think this might be a nightmare, one day my family would come back to me and live together once again" He retrieved his son sobhi 4 years old who was hit as the rest of his brothers" Sobhi was so frightened. When he see the bodies of Palestinian children on TV he closed his eyes and hid them with both hands. I was not able to make my children feel safe anymore especially after the death of 3 of them". The Al-Abssi family is just one Palestinian family who have faced death and lost many of its members. This family is suffering from displacement and trauma. Now, There are hundreds of Palestinian families who have lived the horrors of war and days still reveal the massacres committed by Israeli occupation forces against civilians and children.
